General Purchase Conditions: tickets for Kilian Jornet – What moves us

The Website offers an online ticket purchase service, which is a 24-hour service, simple, direct and available from anywhere through an Internet connection.

1. Generalities

All prices are in Euros and in accordance with current regulations, all purchases made through the Website will be subject to Value Added Tax (VAT), and this amount is included in the price.

The Owner reserves the right to refuse purchases made by any User with whom they have a dispute or with whom there have been problems in the payment of previous purchases.

The price of each ticket is 5 euros (VAT included).

Of the amount paid for each ticket:

  • 2 euros will be allocated to the Fundació Reial Mallorca.
  • 2 euros will be donated to the Kilian Jornet Foundation.

The remaining amount corresponds to the costs of organizing and managing the event.

The final price of the ticket, after deducting the applicable VAT, amounts to 4.13 euros.

The purchase of the ticket implies the express acceptance of the aforementioned financial contribution associated with the event, which is an inseparable part of the ticket price.

2. User Obligations

Any User who makes a purchase through this Website declares that they are of legal age and, where applicable, have full capacity to use payment methods and that they have sufficient funds to cover all costs resulting from the purchase of products. The User also declares to fully and unreservedly accept all the conditions of this Legal Notice.

Each user may only make one purchase of a maximum of 4 tickets for the event.

3. Payment methods and security

In compliance with Commission Delegated Regulation (EU) 2018/389 of 27 November 2017, supplementing Directive (EU) 2015/2366 of the European Parliament and of the Council of 25 November 2015 on payment services in the internal market, users making online payment transactions must do so using strong customer authentication. Depending on the chosen payment method and the transaction value, and subject to the exceptions provided for in the Directive, users may need to provide a second authentication factor before placing an order, such as a PIN code that they will receive on their mobile phone and must enter to validate their purchase.

According to the PSD2 directive, strong customer authentication exists when at least two of the following elements are used for authentication:

  • Knowledge (something that only the User knows, for example, password, PIN code, access data, etc.).
  • Possession (something that only the User has, for example, a mobile phone where an SMS arrives to verify the operation, email address, etc.).
  • Inherence (something that the User is, for example, the possibility of biometric verification, whether by fingerprint, facial recognition, etc.).

These elements are independent of each other. That is, a breach in one does not compromise the reliability of the others, and the confidentiality of identifying data is always protected.

For the User’s convenience, we provide the following payment method:

Credit card.

This payment method is immediate, completely secure, and verified by Redsys’ secure servers on the payment gateway. Your credit card details will never be disclosed.

– Accepted cards are: Visa, 4B, JCB, American Express, Maestro and MasterCard.

Only secure credit cards will be accepted to prevent any potential risk or fraud. Secure cards have associated security codes, and upon completion of payment, you will be redirected to the bank’s payment gateway, where you will need to enter these codes. If you do not have a secure card for online payments, your bank must provide you with the necessary information and codes.

4. Right of withdrawal

In compliance with Law 3/2014, of March 27, which modifies the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws, approved by Royal Legislative Decree 1/2007, of November 16, information is provided on the User’s right of withdrawal.

4.1 When the User is a consumer and the contract is concluded without the simultaneous physical presence of the User and the Owner (distance selling), the User shall enjoy the right of withdrawal described in this section, with the exceptions provided for in Article 103.

4.2 Information to the consumer and user on the right of withdrawal.

a) The User has the right to withdraw from this contract within 14 calendar days without needing to provide a reason.

b) The withdrawal period will expire 14 calendar days from the day of the conclusion of the contract.

c) To exercise the right of withdrawal, the User must notify us of their decision to withdraw from the contract through an unequivocal statement (for example: a letter sent by post or email). You may use the model withdrawal form below, although its use is not mandatory.

d) To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of this right before the withdrawal period expires.

e) In the event of withdrawal by the User, the Owner will proceed to return all payments received without undue delay and, in any case, no later than 14 calendar days from the date on which we are informed of the decision to withdraw from this contract.

4.4 According to Law 3/2014, of March 27, which modifies the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws, approved by Royal Legislative Decree 1/2007, of November 16, in its art. 103, the right of withdrawal will not be applicable to contracts that refer to (among others):

l) The supply of accommodation services for purposes other than housing, transport of goods, rental of vehicles, food or services related to leisure activities, if the contracts provide for a specific date or period of performance.

In relation to this section, with the User’s order, the User gives their prior express consent, with the knowledge and acceptance on their part of the exception contained herein, and consequently in that case, they lose their right of withdrawal.

5. Data Protection

In compliance with current regulations regarding the Protection of Personal Data, you are hereby informed that by accepting these Purchase Conditions, you consent to the processing of your data by Real Club Deportivo Mallorca S.A.D. and Fundació Reial Mallorca, unless you indicate otherwise and at least as long as there is a legal obligation to do so, for the purpose of managing the purchase of your ticket to the event. The data provided is necessary for this purpose. The legal bases for processing are the data subject’s consent and the performance of a contract to which the data subject is a party. The data may be processed for the duration of the contractual relationship and may subsequently be retained to comply with any applicable legal obligations and to address any potential claims up to the maximum limitation period for any actions that may arise from this relationship. Once the limitation periods have expired, the personal data will be deleted.

Furthermore, if you expressly consent by checking the corresponding box, your identification and contact information will be shared with Fundació Reial Mallorca, Fundación Kilian Jornet, and The Normal Company SL so that these entities can send you marketing information. The legal basis for this sharing is your consent, which you may withdraw at any time without affecting the lawfulness of processing based on consent before its withdrawal.

6. Postponements and cancellation of the event

In the event of a postponement or change of date or time, and once a ticket has been purchased by the User, the Owner will use all reasonably available means to inform Users of this change. In this regard, the Owner undertakes to: Publish and communicate the change on the Website and corporate social media as soon as it becomes aware of it in order to keep Users properly informed.

In the event of a postponement or a change of date or time, the User will be offered the option to keep their ticket. If they are unable to attend on the new date, they will be offered a refund of the purchase price. In such a case, the User must inform the Organizer within ten calendar days of the event’s postponement being announced on the website. If the User does not exercise this right within the stipulated period, the Organizer will be entitled to confirm the ticket reservation for the new event date, and the User will not be entitled to a refund.

The above will also apply if you purchased a ticket for the event when the date or time of the event was not yet defined, and only the most likely range will be indicated.

In the event of cancellation due to force majeure, the ticket price will not be refunded. This also applies if the refund is requested after the event has started.

In cases where a refund is possible, the Holder will reimburse the amount within a maximum period of 15 days from the announcement of the change in the manner specified by the entity and provided that the proof of purchase of the ticket is presented.

The Owner will not reimburse any other expenses or costs incurred by the User that were related to the event, including but not limited to management expenses for travel, accommodation or meals.

7. Availability

The Owner agrees not to make available to Users any unavailable entry except in the case of a computer error or other unforeseen circumstance. Should such an unfortunate incident occur, the Owner agrees to inform the User and reach a satisfactory agreement with them.

8. Customer Service

The User will have access to a Customer Service department, for which they can send an email to businessclub@rcdmallorca.es or use the telephone number 971 22 12 21 during business hours and will receive a response as soon as possible, and in any case within the maximum period determined by the applicable legislation.

9. Dispute Resolution

If any dispute arises between the consumer and the seller, the consumer may opt for alternative dispute resolution mechanisms, in accordance with national legislation.

In Spain, you can submit your complaint to the Consumer Arbitration System, which is free and voluntary.

In the European Union, you can request free advice and assistance on cross-border claims from the European Consumer Centres Network (ECC-Net).
